By commissioning me, you agree to my terms of service and conditions.

General Terms & Conditions

❀These terms generally apply to personal and non-profit use commissions. Commercial usage will incur an additional fee depending on use.
✿ I reserve the right to decline any commission offer if it's outside of my capabilities.
❀ Complex designs, props, & backgrounds are subject to additional fees.
✿ I cannot draw anything 18+, gore, horror and mecha. Suggestive sexual themes can be discussed.
❀ Please provide visual references and clear, concise descriptions. DO NOT send me anything generative AI as a reference.
✿ Commissions are prioritized by payment first basis, unless deadlines and rush fees have been included.
❀ All personal information between the artist and client will be kept private and confidential.

Process & Delivery

✿I will inform you once I start working on your commission. Except for skeb-style commissions, updates will be given during the sketch stage, line art stage and color draft stage. We will review the artwork together and will work on revisions (if any) before moving on to the next stage.
❀ The finished artwork will be sent to the client in its original resolution in a PNG file. The default format is A4 300dpi and adjusted according to request. Note that there is no physical product unless it is discussed beforehand.
✿ You can track the queue and progress via trello.

Payment

❀ Wait for the official invoice before sending any payment.
✿ Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval. I will not start any commission unless payment has been made first.
❀ Payment method is via Paypal (USD) or Unionbank / GoTyme / GCash (PHP).
✿ Proof of payment with transaction number must be provided and the payment must already reflect on my end.
❀ A payment plan can be discussed for commissions over 300USD/10,000PHP.

Revisions

✿ Revisions do not apply to skeb-style commissions. I will ONLY do revisions if I made a glaring mistake on my part (i.e. wrong skin tone that was clearly provided in the reference or description.)
❀ You get 3 rounds of revisions included in the price. This is only applicable for the sketch, line art, and color draft stages.
✿ Additional revisions after the color draft stage will be charged depending on the change you want me to make. I will make sure to inform you if a revision you want will be charged before going through with it.
❀ A fee will be added if you want something changed on the final drawing unless a misunderstanding from my side has been made.
✿ I will not be responsible for any mistakes on the final version of any commission due to incorrect or missing information. It is the commissioner's responsibility to provide all relevant information when requesting a commission.

Rights & Usage Policy

I, ayinvui (the artist), reserve the full rights to the artwork and its distribution and use. Therefore, I am allowed to use the copyrighted artwork to do, but not limited to, the following:
✅ Promote myself with it everywhere.
✅ Publish books with it (art books, etc.).
✅ Display it everywhere to my liking (website, social media, portfolio, etc.).
✅ Post it anywhere online.The artist is not allowed to:
❌ Claim any Intellectual Property (IP) that doesn’t belong to the artist.
❌ Make further direct profit out of the artwork.The client is allowed, but not limited, to:
✅ Use the commissioned artwork for personal use.
✅ Print/reproduce any part of the artwork for personal use.
✅ Display it anywhere to your liking.The artist must be attributed and credited when:
✅ Client is using the art as their profile or cover photo.
✅ Client is posting it anywhere online.The following is considered copyright infringement and is not allowed for any reason:
❌ Claiming any part of the artwork as your own.
❌Using any part of the artwork for advertising or profits associated with non-fungible tokens (NFTs) and cryptocurrency.
❌ Feeding/putting the artwork through any generative AI databases.
❌ Altering/editing the artwork without the artist’s explicit permission.The following is not allowed unless you paid for a commercial usage fee:
❌ Using any part of the artwork for promotional and/or advertising purposes. This includes, but not limited to, promotions for yourself, brands, and/or public figures. (Commercial usage fee is double the total price to access this right.)
❌ Reproducing/using any part of the artwork commercially or making money off it in any way. (Commercial usage fee is triple the total price to access this right.)
